Personal Data Protection Act published in the Government Gazette

On 27 May 2019, the Personal Data Protection Act, B.E. 2562 (2019) (“PDPA”) was officially published in the Government Gazette. Under Section 2 of the PDPA, certain provisions become effective immediately the day after promulgation, ie, May 28, 2019. Other provisions will become effective one year after publication.

The key points of the PDPA are summarized in the newsletter “Personal Data Protection Act: A New Era of Privacy Rights in Thailand”, issued by Chandler MHM on 14 March 2019.

Failure to comply with the PDPA could result in significant penalties. Thus, business operators should ensure that their businesses comply with the PDPA. Remaining to be seen are how the many duties the PDPA imposes on operators will be implemented in practice, and how provisions of the PDPA will be interpreted by the authorities. Chandler MHM will keep monitoring any subordinate regulations to be issued under the PDPA, including any compliance practices, and will issue updates on further developments as they occur.
