Finally, long awaited and much welcomed changes to the Cayman Islands’ Companies Act that strengthen the jurisdiction’s role in the international restructuring arena – now more debtor friendly, these amendments aim to make restructuring on island more appealing. With the introduction of automatic moratoriums, restructuring officers, and the removal of the need for a prior winding up petition to be filed, all of which are music to the ears of any restructuring practitioner. Join us as Jeremy and Kimberley from Carey Olsen HK talk through the key proposed amendments and what they mean for debtors and creditors alike.

Kimberley is a senior associate in our Dispute Resolution and Insolvency team, and is based in Hong Kong. Her practice focuses on cross-border restructuring and insolvency, as well as commercial dispute resolution in both the British Virgin Islands and the Cayman Islands. She has particular experience in applications for the appointment of “soft touch” or “light touch” provisional liquidators, cross-border restructurings, and has acted for liquidators on an extensive range of matters arising out of liquidations. She has also acted in high-value and complex commercial disputes involving, inter alia, fraud, breaches of directors’ duties, shareholder disputes, and minority dissent proceedings.

Jeremy is the head of Dispute Resolution and Litigation practice in the Hong Kong office of Carey Olsen. His practice is focused on high value and complex commercial and corporate litigation, insolvency and restructuring matters under the laws of Bermuda, the British Virgin Islands and the Cayman Islands. Prior to joining Carey Olsen, Jeremy was based in the British Virgin Islands with another offshore law firm before relocating in 2017 to lead their litigation, insolvency and restructuring practice in Hong Kong. Jeremy is a member of the Hong Kong ICPA Restructuring and Insolvency Faculty, the International Bar Association, INSOL, IWIRC, the Chancery Bar Association (Overseas Member) and the Inter-Pacific Bar Association.
